Purpose of the By-Laws
The By-laws define the relationship and obligations between the Notting Hill Day Hospital and its Accredited Medical Officers. This document sets out certain terms and conditions upon which Medical Officers may apply to be Accredited within the defined Scope of Practice granted, the basis upon which a successful applicant may admit Patients and/or care and treat Patients at the Facility, and the terms and conditions for
continued Accreditation.
Every applicant for Accreditation will be given a copy of the By-Laws at the time of making an application. It is expected that the By-laws are read in their entirety by the applicant as part of the application process. Notting Hill Day Hospital aims to maintain a high standard of patient care and to continuously improve the safety and quality of its services. The By-laws implement measures aimed at
maintenance and improvements in safety and quality.
Notting Hill Day Hospital is subject to numerous standards and legislation. The By-laws assist in compliance with certain aspects of this regulation but are not a substitute for review of the relevant legislation and standards.
About Notting Hill Day Hospital
Notting Hill Day Hospital is part of a day hospital group owned and operated by City Fertility. It was purpose built and opened in 2021 to support women’s fertility. In early 2018, City Fertility entered a Partnership with CHA Medical Group (CHA), a leading healthcare operator and a premier global leader in fertility and women’s health, and the Singapore Medical Group (SMG), one of Southeast Asia’s largest multi-disciplinary specialist clinic groups.

All Accredited Medical Officers at Notting Hill are expected to:
It is a requirement for continued Accreditation that Accredited Medical Officers comply with the By-laws at all relevant times when admitting, caring for or treating Patients, or otherwise providing services at the Notting Hill Day Hospital. Accredited Medical Officers must comply with all relevant legislation, including but not limited to legislation that relates to health, public
health, drugs and poisons, privacy, health practitioner registration, research, environmental protection, workplace health & safety, occupational health and safety, antidiscrimination, bullying, harassment, industrial relations, care of persons with a disability, substituted decision making and persons with impaired capacity, mental health, Medicare, health insurance, fair
trading and trade practices, intellectual property, and other relevant legislation regulating the Accredited Medical Officer and the provision of health care or impacting upon the operation of Notting Hill Day Hospital.
Accredited Medical Officers must:
- Maintain registration with the Australian Health Practitioner Regulation Agency
(AHPRA) - Respect and support Notting Hill Day Hospital’s Mission Statement;
- Attain and maintain excellence in all episodes of patient care through individual and collective activity and close cooperation with the hospital’s management and staff;
- Comply with relevant Notting Hill Day Hospital Policies and Procedures;
- Treat all staff members with professionalism and respect;
- Abide by the by-laws and work within the limits of their accreditation and scope of practice;
- Comply with the National Safety and Quality Health Service (NSQHS) Standards or other legislated requirements;
- Be aware of the hospital’s emergency procedures;
- Notify the GM or delegate in writing if their professional indemnity insurance lapses; their accreditation is withdrawn or suspended from any hospital or medical institution; or any restrictions are placed on their registration to practice or their
registration is suspended or cancelled; - Adhere to responsible billing practices for patients;
- Comply with reasonable requests to participate in teaching for hospital staff;
- Notify the GM or Medical Director of any potential & actual claims of patient incidentsthat occurred; and
- Avoid treating their own relatives (as per AHPRA guidelines).
The Accredited Practitioner must keep the CEO continuously informed of every fact and circumstances which has, or will likely have, a material bearing upon:
- the Accreditation of the Accredited Practitioner;
- the Scope of Practice of the Accredited Practitioner;
- the ability of the Accredited Practitioner to safely deliver health services to his/her patients within the Scope of Practice;
- the Accredited Practitioner’s registration or Professional Indemnity Insurance arrangements;
- the inability of the Accredited Practitioner to satisfy a medical malpractice claim by a Patient;
- adverse outcomes, complications or complaints in relation to the Accredited Practitioner’s Patients (current or former) of the Facility;
- the reputation of the Accredited Practitioner as it relates to the provision of Clinical Practice;
- the reputation of the Notting Hill Day Hospital.
Standard of conduct and behaviour
The Facility expects a high standard of professional and personal conduct from Accredited Practitioners, who must conduct themselves at all times in accordance with the codes of ethics of the VIC Medical Board, Australian Medical Association, professional Colleges, registration boards or associations and Notting Hill Day Hospital Code of Conduct policy.
Accredited Practitioners, must also conduct themselves at all times in accordance with:
- the values of the Notting Hill Day Hospital;
- the strategic direction of Notting Hill Day Hospital;
- the limits of their registration or any conditions placed upon Scope of Practice in accordance with these By-laws; and
- all reasonable requests made with regard to personal conduct in Notting Hill Day Hospital
